Welcome to GRILL JAPAN. The terms "we", "us" and "our" refer to GRILL JAPAN. GRILL JAPAN operates this store and website, including all related information, content, features, tools, products and services provided through the website (the "Services").

The Services are powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in these Terms (collectively, the "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully before using our website or purchasing our products.

By using our Services, you confirm that you are legally able to enter into a contract under applicable Australian law.

When using our Services or purchasing products, you may be asked to provide information such as your name, email address, billing information, payment information and shipping address.

You agree that the information you provide is accurate, current and complete.

If you create an account, you are responsible for maintaining the security of your account information and for activity carried out through your account.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, images and information provided on our website are accurate.

However, product images may appear differently depending on your device or screen settings.

Product availability, descriptions, packaging and other product information may change from time to time.

We may limit the quantity of products available for purchase or discontinue products at any time.

Nothing in these Terms excludes, restricts or modifies any rights or guarantees that cannot legally be excluded under the Australian Consumer Law.

SECTION 3 - ORDERS

When you place an order through our website, you are making an offer to purchase the products selected by you.

Your order is subject to acceptance by GRILL JAPAN and product availability.

We may refuse or cancel an order where reasonably necessary, including where a product is unavailable, there is an obvious pricing or product description error, or we reasonably suspect fraudulent or unauthorised activity.

If we cancel an order after payment has been made, we will provide an appropriate refund in accordance with applicable law.

Please review your order carefully before submitting it.

Once an order has been accepted, cancellation requests may not always be able to be accommodated.

You agree that products purchased through our website are for personal or household use and not for commercial resale.

SECTION 4 - PRICES AND PAYMENT

All prices are displayed in Australian dollars (AUD), unless otherwise stated.

Prices, discounts and promotions may change from time to time.

The price charged for your order will be the price displayed at the time your order is placed, subject to any obvious pricing or product description error.

You agree to provide accurate and complete payment and contact information when placing an order.

We may use third-party payment providers to process payments. Your use of a third-party payment service may also be subject to that provider's terms and conditions.

If a payment is unsuccessful or cannot be processed, we may be unable to accept or fulfil your order until payment has been successfully received.

SECTION 5 - SHIPPING AND DELIVERY

We currently offer delivery to the Gold Coast and selected areas of Northern NSW.

Delivery is currently provided directly by GRILL JAPAN.

We offer free delivery to the areas we currently service.

Orders placed by 12:00 PM (noon) on Monday will generally be delivered on Thursday of the same week.

Orders placed after the Monday 12:00 PM cut-off will generally be delivered on the following Thursday.

Deliveries are generally made between 8:30 AM and 5:00 PM on Thursdays.

As deliveries are made progressively throughout the day, we are unable to guarantee a specific delivery time.

All products are delivered frozen. You are responsible for ensuring that someone is available to receive the order and that the products can be placed in a freezer as soon as reasonably possible after delivery.

For food safety reasons, we cannot leave frozen products unattended at the delivery address.

If nobody is available to receive the order, the order may be taken back by GRILL JAPAN. Please contact us to arrange the next available delivery.

SECTION 6 - REFUNDS AND PRODUCT ISSUES

Due to the nature of our food products, we do not accept returns or exchanges for change of mind.

If your order arrives damaged, incorrect, or there is a problem with the quality of the product, please contact us as soon as possible after delivery.

Please provide your order number and, where possible, photographs of the product and packaging so that we can assess the issue.

If a product is faulty, damaged or incorrect, we will work with you to provide an appropriate remedy in accordance with our Refund Policy and applicable law.

Nothing in these Terms or our Refund Policy excludes, restricts or modifies any rights you may have under the Australian Consumer Law.

SECTION 7 - INTELLECTUAL PROPERTY

The Services and their content, including but not limited to our trademarks, brand name, logo, text, images, graphics, product descriptions and website design, are owned by or licensed to GRILL JAPAN and are protected by applicable intellectual property laws.

You may use the Services for your personal, non-commercial use only.

You must not reproduce, modify, distribute, publish, display, transmit or commercially exploit any material from our Services without our prior written permission, except where permitted by law.

GRILL JAPAN's name, logo, product names, designs and slogans may be trademarks of GRILL JAPAN or its licensors.

All rights not expressly granted under these Terms are reserved.

Our Services may contain links to or use services provided by third parties, including payment providers and other service providers.

We are not responsible for the content, availability, accuracy or practices of third-party websites or services.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

GRILL JAPAN is powered by Shopify, which enables us to provide the Services to you.

However, purchases made through our online store are transactions between you and GRILL JAPAN.

Shopify provides the technology platform used to operate our online store but is not the seller of the products purchased from GRILL JAPAN.

SECTION 10 - PRIVACY

Personal information collected through our Services is handled in accordance with our Privacy Policy.

By using our Services, you acknowledge that you have read our Privacy Policy.

Because our store is hosted by Shopify, certain personal information may also be collected and processed by Shopify and other service providers as necessary to operate the Services and process your orders.
